Commodity Trading
1. Principles of commodity trading:
(1) Principle of equality: Users and shopping malls have equal legal status in the transaction process.
(2) Freedom principle: Users have the right to voluntarily purchase goods from the mall, and no one may illegally interfere.
(3) Fairness principle: Users and shopping malls shall exercise their rights and fulfill their obligations in accordance with the principle of fairness.
(4) The principle of good faith and trustworthiness: Users and shopping malls shall exercise their rights and fulfill their obligations in accordance with the principle of good faith and trustworthiness.
(5) According to the principle of fulfilling contractual obligations: When users purchase goods from the mall, both the user and the mall have the obligation to complete such transactions in accordance with the provisions of this service agreement (except for transactions prohibited by law or this agreement).
2. Users order goods through the online shopping mall website, and the order is an offer to purchase the goods. When the mall sends an email confirming receipt of the order and delivery confirmation to the user, or directly sends the goods to the user's designated address, it constitutes the mall's commitment to the order, and the contract is hereby established.
3. The mall has the right to withdraw or modify the product information displayed on the mall website if it is found to be incorrect or out of stock. The mall reserves the right to limit the quantity of goods ordered. By placing an order, the user assumes responsibility for the authenticity of the information provided in the order.
4. The price of each product displayed on the mall website includes value-added tax (at the statutory tax rate). The delivery fee will be settled separately based on the delivery method chosen by the user. The mall has the right to change the above information regarding prices and delivery fees.
Packaging: Use new sturdy wooden containers or cardboard boxes for shipping, suitable for long-distance transportation, climate change, and vibration. The seller is obliged to bear the losses caused by poor packaging and insufficient preventive measures. The complete set of operating instructions and protective measures should be indicated on the packaging. If the device is damaged due to the transportation party's error, the seller is responsible for replacing it with a new one for the buyer, and the buyer is not responsible for negotiating compensation with the transportation party.
Warranty: 12 months after receiving the goods (excluding optical lenses and consumables).
Force Majeure: If the seller is unable to deliver or is unable to deliver within the time limit specified in this sales contract due to force majeure events, the seller shall not be held responsible, but must immediately notify the buyer in writing. If the buyer requests, the seller shall provide the buyer with a certificate issued by the China Council for the Promotion of International Trade or relevant institutions by registered mail to prove the existence of the accident.
Arbitration: Any disputes arising from the execution of this contract or related to this contract shall be resolved through friendly negotiation between the parties; If the negotiation fails to resolve the issue, it shall be submitted to the China International Economic and Trade Arbitration Commission for arbitration in accordance with its arbitration rules. The arbitration award is final and binding on both parties.
Technical Services: Starting from the date of acceptance, the seller shall provide free technical guidance and consulting services for the products provided within one year.
User's Rights and Obligations
1. Users have the right to have their username and password in the mall, and use this username and password to log in to the mall website to purchase goods. Users are not allowed to transfer or authorize others to use their mall username in any form.
2. Users have the right to search for product information, post user experience, participate in product discussions, invite followers, upload product images, participate in relevant activities of the mall, and enjoy other information services provided by the mall on the mall website in accordance with the provisions of this agreement and the relevant rules published on the mall website.
3. Users have the obligation to provide their true information when registering and shopping over the phone, and ensure the validity and authenticity of content such as email address, contact phone number, contact address, postal code, etc., to ensure that the mall can contact the user through the above contact methods. At the same time, users also have the obligation to update their registration information in a timely manner when there are changes to the relevant information. The user guarantees not to register or purchase goods on the mall with other people's information.
4. Users should ensure that they abide by the principle of honesty and trustworthiness during the process of purchasing goods on the mall website, and do not disrupt the normal order of online transactions.
5. Users have the right to freedom of speech; And have the right to moderately modify or delete their published articles. Users are not allowed to post comments on the mall that contain the following content:
(1) Those who oppose the basic principles established by the Constitution, incite, resist, or undermine the implementation of the Constitution, laws, and administrative regulations;
(2) Those who incite subversion of state power, overthrow the socialist system, incite and split the country, and undermine national unity;
(3) Damaging national honor and interests;
(4) Those who incite ethnic hatred, ethnic discrimination, and undermine ethnic unity;
(5) Any discrimination based on race, gender, religion, regional content, etc;
(6) Fabricating or distorting facts, spreading rumors, and disrupting social order;
(7) Promoting feudal superstition, cults, obscenity, pornography, gambling, violence, murder, terror, and inciting crime;
(8) Publicly insulting or fabricating facts to defame others, or engaging in other malicious attacks;
(9) Damaging the reputation of state organs;
(10) Other violations of the Constitution, laws, and administrative regulations.
6. In addition to complying with these terms, users should also abide by the relevant regulations of the discussion forum when posting user experiences, discussing images, etc.
7. Without the consent of the mall, users are prohibited from posting any form of advertising on the website.
Website rules, modifications, and separability
1. Price fluctuation rules
The mall will make every effort to ensure that the prices of the products purchased by users are consistent with those published on the website, but the price list does not constitute an offer. Despite the best efforts, a small portion of the products in the mall may have pricing errors. If pricing errors are found, the mall will take one of the following measures:

3. Email/SMS Service Rules
The mall reserves the right to provide order information, promotional activities, and other notification services to this website and mall shopping users through email and SMS. If you do not want to receive emails and messages from the mall other than orders, the mall can process a refund.
4. Delivery Rules

The reference delivery time is calculated based on inventory status, normal processing procedures, delivery time, delivery location, and other factors.
5. Return, exchange, and replenishment rules

6. Change of rules

7. Termination and Cancellation
Users have the right to cancel orders in the following situations:

(2) Before the mall makes a commitment to user orders;

The mall can cancel user orders in the following situations:
(1) Reaching an agreement through negotiation between the user and the mall;

(3) The user's order information is clearly incorrect or exceeds the inventory level of the mall;
(4) Due to force majeure, malfunction of the mall system, or third-party attacks, as well as other situations beyond the control of the mall;

The mall may terminate all or part of the rules, even if the mall does not require or force users to strictly comply with these rules, it does not constitute a waiver of any rights by the mall.
8. Limitation of Liability
(1) Within the limits permitted by laws and regulations, the total liability of the mall for any damages or economic losses caused by the use of mall services shall not exceed the price of the goods purchased by the user in relation to the claim. These liability limitation clauses shall apply to the maximum extent permitted by law and shall remain in effect even after the revocation or termination of user qualifications;
(2) Shanghai Fenchuang Information Technology Co., Ltd. and its affiliated companies do not guarantee that all information provided to users by the mall website or electronic letters sent from the mall website are free from viruses or other harmful substances.
Interruption and termination of services
1. If a user requests to cancel their identity with the mall, and the mall approves the cancellation, the mall will cancel the user and the user will terminate the service agreement with the mall. But after canceling the user account, the mall still retains the following rights:
(1) The mall has the right to retain the user's registration information and previous transaction records;
(2) If the user engages in illegal behavior or violates this agreement on the mall trading platform before cancellation, the mall may still exercise the rights stipulated in this service agreement.
2. In the following situations, the mall can terminate the service by canceling the user:
(1) When a user violates the relevant provisions of this service agreement, the mall has the right to terminate the provision of services to the user. But if the user terminates the service provided by the mall and registers as a mall user again directly or indirectly or in the name of others, the mall has the right to unilaterally terminate the service provided to the user again;
(2) If the mall contacts the user through the information provided by the user and finds that the email address filled in by the user during registration no longer exists or cannot receive emails, and the mall notifies the user to change it through other contact methods, but the user still fails to provide a new email address within three working days, the mall has the right to terminate the service provided to the user;
(3) Once the mall discovers that the main content of the user's registration information is false, the mall has the right to terminate the service provided to the user at any time;
(4) When this service agreement is terminated or updated, the user expressly refuses to accept the new service agreement;
(5) Other shopping malls consider it necessary to terminate the service.
Applicable laws and jurisdiction
This agreement shall be governed by the laws of the People's Republic of China, and all disputes shall be brought to the people's court in the location of the mall
